1. Interpretation

1.1. Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

1.2. Definitions

For the purposes of these Terms and Conditions:

  • “Application” or “Website” means the website and platform provided by the Company, accessible at www.shivanshconsultants.com.
  • “Company” (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Shivansh Consultants, located at F-909, PNTC, Times Of India Press Rd, Satellite, Ahmedabad, Gujarat 380015, India.
  • “Services” refers to the visa and immigration consultancy services, including study visas, visitor visas for 50+ countries, PR, dependent visas, business visas, Germany Opportunity Card, OCI & Passport Services, flight and hotel bookings, travel insurance, and forex services.
  • “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Acknowledgment

2.1. These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

2.2. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, and others who access or use the Service.

2.3. We respect your right to information and aim at providing a transparent set of “Terms”. IF YOU DO NOT AGREE TO ANY OF THE TERMS AND CONDITIONS MENTIONED HEREIN KINDLY DO NOT GIVE YOUR CONSENT AND PROCEED FURTHER TO ACCESS THE Website. By giving your consent to proceed forward in order to access the Services, you will be responsible to adhere to the “Terms” mentioned herein.

 

2.4. This document is an electronic record in terms of the Information Technology Act, 2000 (“IT Act”) and rules made thereunder as may be applicable. This electronic record is generated by a computer system and does not require any physical or digital signatures.

2.5. You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service independently without the consent of a lawful guardian or parent (particularly for dependent or student visas).

2.6. Your access to and use of the Service is also conditioned on Your acceptance of and compliance with our Privacy Policy.

2.7. You acknowledge the grant or refusal of a visa is at the sole discretion of the Embassy and Shivansh Consultants is neither involved in the decision-making process nor is liable or responsible in any manner whatsoever for any delay in processing or grant or rejection of the visa application by the Embassy. The Embassy reserves the right to ask for further documentation and to refuse the visa application.

2.8. You acknowledge that any Estimated Time of Arrival (“ETA”) or visa appointment slot displayed or communicated by the Company is indicative, based on current embassy processing trends, and is not binding on the Company.

3. Your Information & Documentation Support

3.1. In order to avail of the Services, you may be required to register or provide information relevant to Your application, including, without limitation, Your Name, Email, Phone Number, Billing Address, Passport Details, PAN details, financial layouts, and educational matrices.

3.2. You represent and warrant that:

  • The information You supply to us is true, correct, complete, and not misleading.
  • You shall revert to the communications sent by Shivansh Consultants within 24 hours of receipt. Any failure to do so shall entitle the Company to cancel your application, and You shall not hold us liable for any loss/damage due to delay/non-processing of a visa on this account.
  • You shall verify the information provided to the Company at the time of submission and shall carefully read through all instructions.

3.3. By submitting such information, You grant us the right to provide the information to payment processing third parties, consulates, embassies, and authorized visa application centers (like VFS) to facilitate Your Application.

3.4. We provide Documentation & File Preparation services, including document verification, checklist guidance, form filling, and file organization. By submitting a request, you grant us the authorization to complete the said form(s) based on information provided by You and/or submit the form online/physically to the VISA offices of different Countries.

4. Order Cancellation and Refunds

4.1. We reserve the right to refuse or cancel Your Application at any time for reasons including but not limited to:

  • Downtime and availability of Embassy/third-party systems.
  • If any information provided by the User is wrong or incomplete (e.g., wrong travel dates, unclear passport copy), or if the User fails to revert to communication sent by us within 24 hours.

4.2. No Refund Policy: Shivansh Consultants will not refund the Visa fees or the consultancy fees for any reason whatsoever if your visa is rejected by the embassy, consulate, or concerned authorities.

4.3. If You decide to overstay without legitimate approvals at a particular destination, You shall be liable to bear the penalty charges, disciplinary action, and legal proceedings by the Government. Shivansh Consultants will not bear any responsibility.

4.4. If the documents required to process your visa application remain pending or incomplete for a continuous period of ninety (90) days from the date of the document request, your application shall be deemed automatically cancelled. No refund of the service fee or the visa fee will be issued in such cases.

5. Price/Fees Policy

5.1. The Company reserves the right to revise its consultancy prices/fees at any time prior to accepting an order. Pricing information is not publicly specified in the service list; you must contact the business directly for rates. You shall be liable to pay any taxes that may accrue on account of your transaction with Us.

5.2. Applicable visa fees payable to the consulate are subject to modification at any time without prior notice by the embassy, consulate, or any other governmental agency responsible for the processing and issuance of visas.

6. Intellectual Property

6.1. The Service and its original content, features, and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.

6.2. Our trademarks and trade dress (including our brand name, “Your Global Gateway” tagline, and stylized airplane logo) may not be used in connection with any product or service without the prior written consent of the Company.

7. Limitation of Liability

7.1. Specifically, the Company provides the Service as a convenience and in no way implies a warranty for any damages that may occur if a User does not get approval for a visa. The Company expressly limits its liability for losses based on visa refusals.

7.2. Shivansh takes every reasonable precaution while handling the documents of the applicant/s and shall not be liable in any manner whatsoever to the applicant/s for any documents which are lost in transit by accident, theft, natural calamities, or any other reason outside the control of the Company.

 

7.3. You agree and accept that the courier acceptance and delivery service through which documents may be returned to the applicant/s is operated by a third-party vendor. In no event shall Shivansh Consultants and/or its representatives be liable for any direct, indirect, punitive, or consequential damages due to the misplacement, loss, or damage of documents, including the Applicant’s passport, by a courier company.

 

8. Restrictions and Indemnification

8.1. You may use the Application and our Services for reasonable and lawful purposes only. You will not post or upload any content that is libelous, defamatory, abusive, threatening, or otherwise violates any law or right of any third-party.

8.2. You agree to indemnify and defend the Company for losses, liabilities, damages, and/or costs (including reasonable attorney fees) arising from your access to or use of the Services, violation of these Terms, or submission of fraudulent documentation.

You may submit any grievance in connection with the Application or the Services provided by the Company at:

10. Governing Law and Disputes Resolution

10.1. Governing Law: The terms mentioned herein and all related agreements between you and the Company shall be governed by the laws of India. The courts at Ahmedabad, Gujarat, shall have exclusive jurisdiction in relation to matters and/or disputes arising out of this arrangement.

10.2. Dispute Resolution: In case of any dispute or conflict in connection with these Terms and Conditions, you will first try to resolve the dispute informally by contacting the Company. If the dispute is not amicably resolved within forty-five (45) days, it shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Ahmedabad, Gujarat, India.

11. Changes to These Terms and Conditions

11.1. We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
