It applies to two categories: L1A for managers and executives, and L1B for employees with specialized knowledge of the company’s products, services, or processes. To qualify, the applicant must have worked for the qualifying foreign organization continuously for at least one year within the three years preceding the transfer. Like the H1B visa, the L1 allows dual intent, meaning applicants may simultaneously pursue permanent residence. A U.S. employer must first obtain USCIS approval of Form I-129 (or a blanket petition) before the employee can apply for the visa. Final approval rests solely with the U.S. Embassy or Consulate.
